Terms and Conditions of Use for Supamart members pricing program

Effective Date: This is effective from 1 September 2025

Welcome to the Supamart members pricing program and Supamart App (“App”). The App is owned and operated by Supamart Australia (ABN 45 793 629 495) (“Supamart”, “we”, “us”, “our”).

These Terms and Conditions of Use (“Terms”) govern your access to and use of the App. By registering an account or downloading, accessing, or using the App, you agree to be bound by these Terms. These Terms commence on the date the App is downloaded, installed or used.

1. Eligibility

1.1 You must be at least 18 years old to use the App.
1.2 By using the App, you represent and warrant that you meet the eligibility requirements and that the information you provide during registration is accurate and complete.

2. Registration and Account Details

2.1 To access the App, you must create an account by providing all necessary, accurate and complete information (“Account”).
2.2 You are responsible for maintaining the confidentiality of your Account login information and for all activities that occur under your Account.
2.3 You agree to notify us immediately of any unauthorised use of your Account by sending an email to hello@supamartonline.com.au.
2.4 You acknowledge that the App is affiliated with Minskys Local Liquor and from time to time, the Supamart members pricing program may contain cross promoted bundles of food and liquor offers. However, the App is to be used for redemption for all Supamart offers unless directed by the relevant promotional terms of use that are separate from these Terms.

3. The Members Pricing Program and The App

3.1 The App offers a loyalty program that provides members with special pricing on selected products and services (“Member Pricing”) at Supamart stores.
3.2 Member Pricing is available only to registered users of the App.
3.3 Member Pricing cannot be combined with any other discounts, offers, or promotions unless explicitly stated.
3.4 The availability of Member Pricing is subject to change at our discretion.
3.5 By joining the Member Pricing program, you will get access to a number of ongoing benefits, including:

  1. You will receive the Members Price on items as ticketed in-store.
  2. You will receive communications (emails and text messages) regarding items that are at the time ticketed with Member Pricing, specials and promotions.
  3. E-Receipts of your purchases will be stored on your App and can be used to as proof of purchase.
  4. From time to time, Supamart and Minskys Local Liquor may also offer other rewards to you as part of its promotional activities.

4. Use of the App

4.1 You agree to use the App only for lawful purposes and in accordance with the relevant state and commonwealth laws.
4.2 All offers via the App from Supamart and Minskys Local Liquor are applicable for in-store purchases only.
4.3 Users will receive the relevant discount offered on each item at the point of sale, once the Members Pricing program identification in the App has been acknowledged by the point of sale system. Access to Members Pricing is only available to App users who hold an Account.
4.4 Offers received on the App are not transferable to anyone else other than the user of the App.
4.5 You must ensure that any changes to your Account details are promptly updated in the App. This includes ensuring that your email address and mobile phone number provided on the Account are current and in use by you.

5. Terminating Your Account

5.1 You can terminate your Account for the Members Pricing program anytime by:

  1. notifying our team that you wish to end your participation by sending an email to hello@supamartonline.com.au; and
  2. removing your App from your smartphone.

5.2 Once you have provided notification of termination, you will no longer be able to receive the Members Pricing.
5.3 Upon termination of your Account, we will remove all records of your Account, including your e-receipts, from our database, and you will lose all your stored information on your Account.

6. Marketing communications

6.1 You will get the most out of your Members pricing program if you agree to receive communications from Supamart and Minskys Local Liquor.
6.2 Any communication sent by us will be in accordance with our privacy policy.
6.3 You can unsubscribe anytime from Supamart marketing communications through the unsubscribe function that will be made available to you with each direct marketing communication, or by sending an email to hello@supamartonline.com.au and requesting to be removed from the program’s emails.

7. Privacy

7.1 In order to operate and provide the App, we may collect information about you and your use of the App, which may include personal information (as defined under the Privacy Act 1988 (Cth).
7.2 By using the App, you agree that we will collect, use and disclose your personal information as described in this section and our privacy policy.
7.3 The types of personal information that we may collect from or about you include:

  1. your contact details such as your name, address, telephone number and email address, your date of birth, your home or closest store and your transaction history; and
  2. in addition to the above, if you submit an order through the App, the contact details of any person you nominated to pick up or receive delivery of your order, payment information (such as credit card or bank details), your government ID (such as driver’s licence) if you purchase certain products (such as alcohol or tobacco) or services we provide and transaction details relating to your purchase or use of our products, services and benefits.

7.4 The purposes for which we will use this personal information include:

  1. to provide our App (and its full functionality) to you;
  2. to improve the service provided through the App and to provide additional functionality to the service;
  3. to administer your Account;
  4. and any other lawful purpose.

7.5 We may disclose your Personal Information to third parties in accordance with our privacy policy, including to:

  1. financial institutions for payment processing; and
  2. our contracted service providers, including:
    • manufacturers and suppliers;
    • couriers and delivery contractors;
    • marketing consultants and promotions companies;
    • website hosts; and
    • consultants and professional advisers.

7.6 We may also disclose your Personal Information to third parties where you or another person authorised by you instruct us to do so or otherwise in accordance with our privacy policy.

8. Limitation of Liability

8.1 To the fullest extent permissible by law, we are not liable to you for any damages of any kind arising from your use of or inability to use the App, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

9. Changes to Terms and Conditions

9.1 We reserve the right to modify these Terms from time to time. We will notify you of any changes by posting the new Terms on the link in your App, and on our website located at https://supamartiga.com.au/supamart-members-pricing-terms-conditions/.
9.2 Your continued use of the App following the posting of changes constitutes your acceptance of such changes.
